Terms and Conditions

These Terms and Conditions ("Terms") govern the sale of products through finogadget.com (the "Website"). Please read them carefully before placing an order. By placing an order you confirm that you accept these Terms.

Finogadget is operated by BIZZER LLC, a company incorporated in the State of Delaware, United States of America, with its registered office at 16192 Coastal Hwy, Lewes, DE 19958-3608, United States ("Finogadget", "we", "us", "our"). You can contact us at info@finogadget.com.

This document is organised in two parts. Part 1 sets out the terms that apply to our cash-on-delivery (COD) and other sales to customers located in the European Union / European Economic Area ("EU/EEA"), which is our primary market (currently Spain, Portugal, Italy, Slovakia, Slovenia, Bulgaria, Romania, Greece, Czech Republic, Poland, Hungary, Germany, Lithuania, Latvia). Part 2 sets out how we, as a company established in the United States of America (Delaware), comply with United States federal and state law, and the terms that apply to customers located outside the EU/EEA. Where both parts could apply to you, the more specific and more protective provisions of Part 1 prevail for EU/EEA consumers; nothing in Part 2 reduces the rights granted to you in Part 1.

Definitions

By using the Website and placing an Order, you agree to be bound by these Terms, together with our Privacy Policy, Cookie Policy, Shipping Policy and Refund & Returns Policy, which are incorporated by reference. If you do not agree, please do not place an Order.

Part 1 — Sales to European Union / EEA consumers (cash-on-delivery)

1.1 Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to place an Order. By ordering, you confirm that you meet these requirements and that the information you provide is accurate and complete.

1.2 Products, descriptions and availability

We take care to describe and picture our Products accurately, so that you can make an informed decision before ordering. Images are for illustration only, and slight variations in colour, packaging or minor detail may occur. All Products are subject to availability. We may withdraw a Product, or correct an error in its description or price, at any time before your Order is accepted.

Product safety. In line with Regulation (EU) 2023/988 (General Product Safety Regulation), where applicable we provide, on the product page or on the Product or its packaging, the name and contact details of the manufacturer and of the person responsible for the Product in the EU, an identifier of the Product (such as a model or batch number), and any safety warnings and instructions in the language of the country of sale. If you have a safety concern about a Product, contact us at info@finogadget.com.

1.3 Prices and taxes

Prices are shown on the Website in the currency indicated at checkout and are subject to change, but changes do not affect Orders we have already accepted.

Unless stated otherwise, prices for consumers include applicable value-added tax (VAT). Where an Order is shipped from outside the EU/EEA, additional import duties or taxes may apply and are described in our Shipping Policy.

Any delivery or cash-on-delivery charges are shown separately before you confirm your Order.

If we discover an obvious pricing error, we are not obliged to supply the Product at the incorrect price and will contact you before proceeding.

1.4 How a Contract is formed

Your Order is an offer to buy. After you place an Order, we will send you an acknowledgement confirming that we have received it; this acknowledgement does not by itself form a Contract. The Contract is formed only when we confirm that your Order has been accepted or when we dispatch the Products, whichever happens first. We reserve the right to decline any Order, for example where a Product is unavailable, where we cannot obtain authorisation for payment, where we suspect fraud, or where there has been a pricing or description error.

1.5 Payment, including cash on delivery

We accept the payment methods displayed at checkout, which may include cash on delivery (COD) and, where offered, secure online payment. Where you choose cash on delivery, you agree to pay the full amount (including any applicable charges) to the courier at the time of delivery. Online payments are processed by third-party payment providers; we do not store your full card details.

1.6 Delivery

We deliver to the destinations, and within the timeframes, set out in our Shipping Policy, which forms part of these Terms. Delivery times are estimates and are not guaranteed unless expressly agreed. Risk in the Products passes to you on delivery.

1.7 Right of withdrawal for EU/EEA consumers

If you are a consumer in the EU/EEA, you have the right to withdraw from your Contract within 14 days of receiving the Products, without giving any reason, in accordance with Directive 2011/83/EU on consumer rights. Full details of how to exercise this right, the conditions, and the refund process are set out in our Refund & Returns Policy, which includes a model withdrawal form. You can withdraw online, at any time during the withdrawal period, using the "Withdraw from contract here" function on our website.

1.8 Legal guarantee of conformity

Where you buy as a consumer in the EU/EEA, the Products benefit from the statutory guarantee of conformity: we are liable for any lack of conformity that becomes apparent within two years of delivery, in accordance with Directive (EU) 2019/771 and the consumer-protection law of your country. If a Product is faulty, not as described, or not fit for its purpose, you are entitled to have it repaired or replaced and, where appropriate, to a price reduction or a refund. These statutory rights are not affected by any commercial warranty we may offer or by these Terms.

1.9 Returns and refunds

Your rights to return Products and receive refunds — whether under the right of withdrawal or the legal guarantee — are described in detail in our Refund & Returns Policy.

1.10 Complaints and dispute resolution

We want you to be satisfied. If you have a complaint, please contact us first at info@finogadget.com so we can try to resolve it. If we cannot resolve your complaint directly, EU/EEA consumers may be able to use an alternative dispute resolution (ADR) body in their country, or seek assistance from the European Consumer Centres Network (ECC-Net) for cross-border purchases. (The former EU Online Dispute Resolution platform was discontinued on 20 July 2025 and is no longer available.)

1.11 Mandatory consumer rights preserved

If you are a consumer in the EU/EEA, you benefit from, and may bring proceedings under, the mandatory consumer-protection provisions of the law of your country of residence, and nothing in these Terms (including Part 2 below) deprives you of that protection.

1.12 Countries we serve

We currently sell to consumers in the following countries: Spain, Portugal, Italy, Slovakia, Slovenia, Bulgaria, Romania, Greece, Czech Republic, Poland, Hungary, Germany, Lithuania, Latvia. The consumer-protection law of your country of residence applies to your Contract in addition to these Terms, and any mandatory right it gives you prevails over anything to the contrary in these Terms.

Part 2 — United States compliance and other customers

BIZZER LLC is a limited liability company organised under the laws of the State of Delaware, United States of America. This Part sets out our company information, describes how our sale of Products complies with United States law, and governs customers located outside the EU/EEA. It does not reduce any right granted to EU/EEA consumers under Part 1.

2.1 Information about us

2.2 Consumer protection and truthful advertising

Section 5 of the Federal Trade Commission Act prohibits unfair or deceptive acts or practices. In line with it, with the FTC Guides Concerning the Use of Endorsements and Testimonials in Advertising (16 CFR Part 255) and with the FTC Trade Regulation Rule on the Use of Consumer Reviews and Testimonials (16 CFR Part 465), we state prices clearly, describe the Products accurately and in line with their specifications, publish only genuine customer reviews, and do not use fake urgency or misleading reference prices. We apply the same standard globally, including in our advertising on platforms such as Google Ads and Google Shopping, and we keep our product pages, Merchant Center listings and advertising consistent.

2.3 Electronic contracts

Under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001 et seq.) and the Delaware Uniform Electronic Transactions Act (Title 6, Chapter 12A of the Delaware Code), an Order placed and accepted electronically, and any electronic record or communication exchanged between us (including order confirmations), is valid and enforceable in the same way as a paper document.

2.4 Warranties

Where United States law applies to your Contract (see Section 2.6), the Products are covered by the implied warranties provided by the Uniform Commercial Code as adopted in the applicable State, including the implied warranty of merchantability, and we do not exclude or limit any warranty or remedy that cannot be excluded or limited under applicable law. Any written warranty we offer for a Product will be made available in accordance with the Magnuson-Moss Warranty Act (15 U.S.C. § 2301 et seq.).

2.5 Customers outside the EU/EEA

If you are ordering from outside the EU/EEA, the withdrawal right described in Section 1.7 does not apply to you as a matter of EU law; instead, we offer a voluntary return option described in our Refund & Returns Policy (currently a 30-day window from delivery), which meets or exceeds the minimum return-window requirements of Google Merchant Center. This voluntary policy does not limit any mandatory right you may have under the law of your own country or State.

2.6 Governing law and jurisdiction

These Terms, and any Contract with a customer located outside the EU/EEA, are governed by the laws of the State of Delaware and the applicable federal laws of the United States, without regard to conflict-of-laws principles, and the state and federal courts located in the State of Delaware have non-exclusive jurisdiction over any dispute, without prejudice to your right to bring proceedings in the courts of your own State or country where mandatory consumer law so provides. For consumers in the EU/EEA, Section 1.11 above applies and is not affected by this clause.

General provisions

Your responsibilities and acceptable use

Intellectual property

All content on the Website — including text, graphics, logos, images, product descriptions and the "Finogadget" brand — is owned by or licensed to us and is protected by intellectual-property laws. You may not use it without our prior written permission, except as necessary to use the Website for its intended purpose.

Our liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for the statutory rights of consumers. Subject to that, we are not liable for losses that were not foreseeable, for losses not caused by our breach, or for business losses where you use the Products for any commercial purpose. Our total liability arising out of any Contract shall not exceed the price paid for the relevant Products, except where a higher amount is required by mandatory law.

Events beyond our control (force majeure)

We are not responsible for any failure or delay in performing our obligations where that failure or delay is caused by events beyond our reasonable control, such as natural disasters, extreme weather, epidemics, strikes, transport disruption, failure of utilities or communications networks, or acts of government. We will take reasonable steps to minimise the effect of any such event.

Changes to these Terms

We may amend these Terms from time to time. The version applicable to your Order is the one in force at the time you place it. Please review the Terms each time you order.

Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full effect. Our failure to enforce a right is not a waiver of that right. You may not transfer your rights under a Contract without our consent; we may transfer ours where your rights are not affected.
